FUEL TANK AND HOUSING WARRANTY

Hardin Industries, Inc.

All UL listed above ground fuel tank and generator housing sales are subject to the following terms and conditions as it Warranties:

Hardin Industries Inc. warrants its products against defects in workmanship and materials under normal use and conformance with manufacturers instructions for installation and use for a period of one year from the date of sale determined by invoice date, which Hardin Industries Inc.’s examination shall disclose to its satisfaction to be thus defective.

It is agreed Buyer and Hardin Industries Inc. will constitute a sole and exclusive remedy and agree this remedy and all sales are made subject to the condition that Hardin Industries Inc. is not liable for consequential damages or for personal injuries of its customers or others.

Hardin Industries Inc. will not warrant installation of fuel tank or generator housing.  Alteration of design or repairs without written authorization will void warranty.

During such period, Hardin Industries will repair or replace, at its option, such defective parts without cost to buyers, provided buyer pays shipping charges for return of such products to Hardin Industries.

Electrical parts are warranted only to the extent of the warranty provided by the respective manufacturers of such parts.

Fuel tanks and generator housings must be properly maintained after arrival at destination by shipper. Whoever is responsible for receiving the generator and housing unit after shipment from Hardin Industries, Inc. must power wash unit after it arrives at shipping destination to remove any corrosive material that may have accumulated on unit from being transported, such as road salts and de-icing agents, etc. Hardin Industries, Inc. cannot be held responsible for any damage occurring from failure to maintain unit properly.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS OR PRODUCTIVENESS.  THIS WARRANTY SHALL NOT APPLY TO ANY HARDIN INDUSTRIES PRODUCT OR ANY PART THEREOF WHICH HAS BEEN THE SUBJECT OF ACCIDENT, NEGLIGENCE, ABUSE, OR MISUSE.  THIS WARRANTY DOES NOT APPLY TO ACCESSORIES OR PARTS NOT SUPPLIED BY HARDIN INDUSTRIES. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION OF THE FACE THEREOF. HARDIN INDUSTRIES INC. NEITHER ASSUMES, NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH ITS PRODUCTS.
